My obligations under the EPR scheme on professional packaging

Companies considered to be producers placing professional packaging on the market will have three main obligations under the EPR scheme on professional packaging (EPRO): declare the packaging placed on the market, finance its end-of-life management through the eco-contribution, and contribute to collective reduction, reuse and recycling targets.

Twiice can support you now so that you can anticipate these obligations and prepare for their implementation under the best possible conditions.

Declare packaging placed on the market

Every year, producers placing products on the market will have to declare the professional packaging they place on the market in France.
This declaration is the basis of the EPR system. It will be used to calculate the eco-contribution payable by each company and to feed the scheme’s national indicators (waste reduction, reuse, recycling, etc.).
The detailed declaration procedures are provided at the beginning of your support journey.

Finance packaging end-of-life management

EPR is based on a simple principle: the producer placing packaging on the market finances the management of the waste generated by that packaging.
This financing takes the form of an eco-contribution calculated on the basis of the packaging declared.
The amount depends in particular on:
• the materials used;
• the quantities placed on the market;
• the packaging use category;
• collection and recycling costs;
• eco-modulation criteria.

Contribute to the scheme’s targets

The EPR scheme on professional packaging is not only about financing waste collection. It also aims to accelerate the transition towards packaging that uses fewer resources, is better recycled and is reused more widely.
By joining an approved producer responsibility organisation, companies collectively contribute to achieving the targets set by French and European regulations.

Focus on eco-modulation

Eco-modulation adjusts the amount of the eco-contribution according to the environmental characteristics of packaging. In practical terms, the better a packaging solution performs (reusable, recyclable, resource-efficient), the lower its contribution.

This mechanism enables EPR to financially reward the best-performing packaging, with reusable packaging benefiting in particular.

FAQ

You are subject to it if you are considered a “producer” under the Extended Producer Responsibility (EPR) scheme for professional packaging. There are three main scenarios: you manufacture, or have manufactured, packaging under your own brand; you manufacture, or have manufactured, products packaged in sales packaging; or you import products of which you are not the end user.

Vous avez un doute ?

The eco-contribution is the amount you pay to Twiice to finance the management of your packaging waste. Eco-modulation is the mechanism that adjusts this amount according to the environmental characteristics of your packaging. Reusable packaging benefits from a 50% reduction, and reused packaging gives rise to no new contribution.

Yes. It will have to be declared so that packaging flows can be monitored, but no new eco-contribution will be payable after its first placing on the market.

The French Environmental Code (Article L. 541-9-5) provides for several administrative and financial penalties for failure to comply with EPR obligations:
– a fine of up to €7,500 per unit or tonne placed on the market;
– a daily penalty payment of up to €20,000 until the situation is remedied;
– a fine of up to €30,000 for failure to register in SYDEREP (the French national EPR register), incorrect data or absence of a Unique Identifier (IDU).
